How Pennsylvania's New First-Time DUI Offenders Law Works

After August 25, 2017, a new Pennsylvania law will allow persons convicted of first-time drunk driving to avoid a complete license suspension by PennDOT, formerly a mandatory, administrative procedure.

Under current law, a first-offense DUI conviction in Pennsylvania for driving under the influence of alcohol results in a mandatory one-year license suspension, for a BAC above .10, with limited exceptions.

Like an expanded version of Pennsylvania's existing occupation limited license (OLL), also known as a "bread and butter" license, convicted individuals meeting the new law's criteria will be eligible for an ignition interlock limited license, or "IILL," which allows them to utilize an ignition interlock system, for both personal and occupational use of their vehicle.

Previously, ignition interlock devices were only available to first-time DUI offenders when ordered by a judge during sentencing. The new law is a crucial step in keeping those with first-time DUI convictions traveling, for work, family and all other important matters.

Like all laws, this new DUI law has fine print, and may need to be combined with other measures to ensure maximum use of a vehicle following a DUI conviction for a BAC above .10.
